Acceptance

These Terms of Service ("Terms") govern your use of Kinky Match (the "Service"), which is developed and operated independently ("we," "us," "our"). By confirming you're 18 or older and continuing past the entry screen, you agree to be bound by these Terms. If you don't agree, don't use the Service.

What Kinky Match is

Kinky Match is a private compatibility quiz for 1-8 people who explicitly invite each other into the same session. There are no user accounts — no signup, no login, no password. Your presence in a session is your own invite link and, optionally, a display name you choose. There is no public directory, no stranger-matching, and no way for anyone to discover or browse other sessions.

Eligibility — adults only

THIS SERVICE IS FOR ADULTS ONLY. By using the Service, you represent that you're at least 18 years old (or the age of majority in your jurisdiction if older), that you're aware the Service includes adult-themed, sexually explicit question content once you pass the entry screen, and that accessing it is lawful where you live. You're solely responsible for complying with your own jurisdiction's laws regarding access to this kind of content.

Your content & conduct

Almost everything you see in Kinky Match is our own fixed, curated question content — you don't write it, and it can't be edited by any participant. The only things you can type yourself are: an optional session name, an optional display name, and whatever you submit through the feedback form. Session names and display names are visible to other participants in the same session; feedback is sent directly to us and isn't shown to anyone else.

For any of these, you agree not to:

• Impersonate any real person, or falsely claim to be someone you're not;
• Include anything illegal, threatening, or that depicts or references a minor in any sexual context;
• Include another real person's private information without their consent (their name, contact details, address, etc.);
• Use the field to harass, threaten, or abuse anyone, including us.

We reserve the right to remove a session or suspend access to it if a name field is used to violate these Terms, and to report unlawful content to the appropriate authorities where required.

Not a dating or introduction service

Kinky Match never introduces you to anyone or suggests people to connect with — every participant in a session got there because someone who already knew them sent them a link. We don't run background checks on anyone, including people you choose to invite, and we make no representation about anyone's identity, intentions, or honesty. Any decision to meet, communicate with, or act on anything discussed through the Service outside of it is entirely your own, at your own risk — see our Consent Guidelines for the baseline precautions we'd encourage regardless.

No hosted adult imagery

Kinky Match does not host, accept, or display any user-uploaded photos, videos, or other visual depictions — the entire product is text-based questions and short free-text fields described above. Because no actual sexually explicit visual content is hosted on the Service, the U.S. federal recordkeeping requirements under 18 U.S.C. §2257/2257A do not apply to this Service.

Intellectual property

The question bank, software, design, and branding of Kinky Match belong to us and are protected by copyright and other applicable laws. You're granted a limited, non-exclusive, non-transferable right to use the Service for its intended personal purpose — nothing here gives you rights to copy, resell, or build a competing product from our content.

For the small amount of content you provide yourself (your display name, session name, and feedback messages), you grant us only the limited right necessary to store, display it to the other participants in your own session (where applicable), and operate the Service — we don't use it for marketing, and we don't claim ownership of it.

Availability & pricing

Kinky Match is currently offered free of charge. We may change, suspend, or discontinue any part of the Service at any time, and we reserve the right to introduce paid features in the future — if we do, we'll give reasonable advance notice before charging anyone for something that's currently free.

Termination

We may suspend or terminate your access to a session at any time, with or without notice, if we believe you've violated these Terms, misused the age-gate or bot protection, or used the Service for anything unlawful. Since there's no persistent account, "termination" mainly means revoking access to a specific session or invite link. You can stop using the Service at any time; see our Privacy Policy's retention section for what happens to an inactive session's data.

Disclaimers & limitation of liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DON'T WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY MATCH OR RESULT IS ACCURATE OR SUITABLE FOR YOUR SITUATION.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING ANY DAMAGES RESULTING FROM INTERACTIONS, DECISIONS, OR ACTIVITIES WITH OTHER PARTICIPANTS THAT TAKE PLACE OUTSIDE THE SERVICE. BECAUSE THE SERVICE IS CURRENTLY FREE, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM YOUR USE OF THE SERVICE IS LIMITED TO $50 USD.

Nothing in this section limits liability that can't be limited under applicable law (for example, liability for our own gross negligence or willful misconduct, where the law doesn't allow that to be limited).

Indemnification

You agree to indemnify and hold us harmless from any claims, losses, or expenses (including reasonable legal fees) arising from your violation of these Terms or your misuse of the Service, including anything you submit through a free-text field or the feedback form.

Governing law & disputes

These Terms are governed by the laws of the jurisdiction in which you reside. Because this is a free, non-commercial service provided independently, we hope any issues can be resolved amicably. If formal proceedings are required, they will be brought in the competent courts of your local jurisdiction.

If you're a consumer in the EU, you may also use your national Alternative Dispute Resolution (ADR) body or your national Consumer Centre (part of the European Consumer Centres Network, ECC-Net) to resolve a dispute with us informally.

Changes to these Terms

We may update these Terms as the Service changes. If we make a material change, we'll update the date at the top of this page. Continuing to use the Service after a change means you accept the revised Terms. If you don't agree to a change, stop using the Service.
